The court held that conduct on social media can be viewed as a state action when the official in question "possessed actual authority to speak on the state's behalf" and "purported to exercise that authority." While the officials in both cases have low profiles, the ruling will apply to all public officials who use social media to engage with the public. The cases raised the question of whether public officials' posts and other social media activity constitute part of their governmental functions. The court is wrestling with a whole series of social media-related free speech issues in its current term, which runs until June.

WASHINGTON (AP) — The Federal Communications Commission has enacted new rules intended to eliminate discrimination in access to internet services, a move which regulators are calling the first major U.S. digital civil rights policy. FCC Chairwoman Jessica Rosenworcel said that Congress required the agency to adopt rules addressing digital discrimination, through bipartisan infrastructure legislation passed at the start of the Biden administration. Poorer, less white neighborhoods were found to have received lower investment in broadband infrastructure and offered worse deals for internet service than comparatively whiter and higher-income areas. It is simply not plausible that we could prevent and eliminate digital discrimination by solely, solely addressing intentional discrimination,” said fellow commissioner Geoffrey Starks. President Joe Biden has said the investments in the bipartisan infrastructure law are meant to connect every U.S. household to quality internet service by 2030 regardless of income or identity.

These two hopeless loners are the only people in the bar in this Off Broadway revival of John Patrick Shanley’s “Danny and the Deep Blue Sea,” at the Lucille Lortel Theater. Though modest in scale, the show is one of the fall’s hottest thanks to its stars, Aubrey Plaza and Christopher Abbott. Shanley’s writing sometimes devolves into hard-boiled mannerisms, but it also has a sharp pugnaciousness. Similarly, Abbott and Plaza’s performances move beyond histrionics and gain confidence as their characters start letting themselves feel. When Danny and Roberta finally strike up a conversation, it immediately reveals their combustible approaches to life itself.

Islamic State, also known as ISIS, called for attacks on Jewish communities in the United States and Europe; the Lebanese militant group, Hezbollah, threatened to attack American interests in the Middle East; and Al Qaeda also issued a specific call to attack the United States, Mr. Wray said. Mr. Wray said that the man, who prosecutors identified as Sohaib Abuayyash, 20, had been studying how to build bombs and posted details online about his support for killing Jewish people. Mr. Wray’s testimony came as threats to Jewish, Muslim and Arab communities in the United States have been on the rise since the war began on Oct. 7. The Justice Department’s inspector general found no evidence that President Donald J. Trump had improperly pressured the F.B.I. to rebuild its headquarters on its current site, the crumbling J. Edgar Hoover Building in Washington, according to a report released on Tuesday. The investigation began four years ago after some Democrats expressed concern over the bureau’s abrupt decision in late 2017 to scrap plans to build a $3 billion suburban campus for its 10,000 employees. But investigators determined that the decision was most likely motivated by funding and logistical issues, not by an effort by Mr. Trump to personally intervene to protect his property in downtown Washington from a possible rival. witnesses, including the bureau’s director, Christopher A.
